Finney County commissioners will be holding a public hearing Monday to vote on a road closure petition, following a short-lived legal battle led by state transportation officials to stop the county from taking action.
A district court judge denied a legal request by the Kansas Department of Transportation in early January to stop Finney County officials from taking action on a road closure request by Presta Oil Inc., the company that owns the Presto convenience store at 7935 W. U.S. Highway 50. Presta is requesting to vacate road abutting the property.
KDOT first filed its injunction request in late October, arguing that if the county were to hear and approve Presta Oil's road closure petition, the transportation agency would not be able to "provide adequate detouring during construction and reasonable access to all abutting property owners after completion of the project," according to district court documents.
KDOT officials believed the closure would inhibit public access to frontage roads because two other properties to the west of Presto -- land belonging to George Rapp and Carson Hobbs -- already were closed to public access following petitions filed with the County Commission that were unanimously approved earlier this year.
The road viewing is scheduled for 10:30 a.m. Monday at the store's site, and a public hearing will immediately follow at 10:45 a.m. at the USD 363 district office in Holcomb, located at 204 Wiley St.
During their Monday meeting, commissioners also will review an annual report from the Noxious Weed Department.
