Teen to be tried as adult in beating case

A 17-year-old charged with attempted second-degree murder in connection with the beating of a Garden City resident will be tried as an adult, according to the Finney County Attorney's Office.
District Magistrate Judge Richard Hodson made the determination in a hearing Friday morning.
Hernandez is accused of taking part in the gang-related beating of 18-year-old Adam Rosas in late December at H and H Trailer Park off of U.S. Highway 50. Rosas was hospitalized in Wichita with numerous injuries to his head and torso.
Hernandez also has been charged with conspiracy to commit aggravated battery.
His arraignment is scheduled for 10 a.m. July 28, according to the county attorney's office.
Depending on a person's criminal history, an adult conviction of attempted second-degree murder can carry a prison term from three years and two months to 14 years and four months. Conspiracy to commit aggravated battery can carry a prison term from one year and five months to three years and 10 months.
Hernandez joins nine others who have been charged in connection with the beating. Eight have entered plea agreements with the state, while another teen, Marina Guardiola, 15, will be tried as a juvenile.
Guardiola, who faces allegations of aggravated battery and conspiracy to commit aggravated battery, is scheduled to go to trial at 9 a.m. Aug. 5.
